Public Records
Art. I, s. 24, of the Florida Constitution, and Florida’s Public Records Law, Ch. 119, Florida Statutes, provide a right of access to state and local government records. This right of access applies to all records made or received by an agency in connection with the transaction of official business which are used to perpetuate, communicate or formalize knowledge. In the absence of an exception established by statute or the Florida Constitution, all such materials are open for public inspection.
Arrest and crime reports are generally considered to be open to public inspection. However, statutory exceptions for active criminal investigative and intelligence information, confessions, certain juvenile offender records, certain victim information, and other provisions of confidentiality or exemptions may apply. Other information, such as the home addresses, telephone numbers, dates of birth, and photographs of active or former sworn or civilian law enforcement personnel, is also exempt.
