Public Hearing - Small Scale Amendment and Rezoning

Legal Notice

NOTICE is hereby given that the City of West Melbourne, Brevard County, Florida, has called for Public Hearing(s) to be held as follows:

West Melbourne Planning and Zoning Board, March 14, 2023, 6:30 p.m., or as soon thereafter as the matter may be heard in the City Council Chambers, 2285 Minton Road West Melbourne, Florida. This meeting may include the attendance of one (1) or more members of the West Melbourne City Council who may or may not participate in the Board discussions held at this public meeting. 

West Melbourne City Council, March 21, 2023, at 6:00 p.m., or as soon thereafter as the matter may be heard in the Council Chamber located at 2285 Minton Road, West Melbourne, Florida.  The City Council will take public comment, the Planning and Zoning Board’s recommendation and consider the following:

A request for small scale comprehensive plan amendment, (SSA) to change the land use designation on 4.20 acres of property located at 4340 W. New Haven Avenue and assigned Parcel Identification Numbers 28-36-02-25-*-1 and 28-26-02-25-*-3 by the Property Appraiser of Brevard County, from Brevard County Community Commercial (CC) to City of West Melbourne Commercial (COM) and to consider rezoning from Brevard County BU-1 (General Retail Commercial) to City of West Melbourne C-P (Commercial Parkway), on property more particularly described as follows: 

Lots 1 and 2, Valencia Subdivision of Lots 22 and 27, Florida Indian River Land Company Subdivision, Section 2, Township 28 South, Range 36 East, as shown in Plat filed in Deed Book 3369, Page 146, Public Records of Brevard County, Florida, less and except road rights-of-way. Also   described as follows: Lots 1 and 2, less and except road rights-of-way, Valencia Subdivision, as recorded in Deed Book 339, Page 146, of the Public Records of Brevard County, Florida; said Valencia Subdivision being a resubdivision of Lots 22 and 27, Florida Indian River Land Company Subdivision, as recorded in Plat Book 2, Page 80, of the Public Records of Brevard County, Florida. Said property is situated in Section 2, Township 28 South, Range 36 East, Brevard County, Florida

And  

Lot 3, Valencia Acres, a subdivision of Lots 22 and 27, Section 2, Township 28 South, Range 36 East, of the Plat filed in Deed Book 339 at Page 146, of the Public Records of Brevard County, Florida.  

The Planning and Zoning Board will take public comment, consider the items, and make a recommendation to the City Council. 

The proposed comprehensive map amendments and rezonings are available for public inspection at City Hall, 2240 Minton Road, West Melbourne, Florida. All persons wishing to be heard should appear in person at these hearings or send written comments to the City Clerk.  All persons and parties are hereby advised that if they should decide to appeal any decision made by the City with respect to any matter considered at the public meeting or hearing described in this notice, they will need a record of the proceedings, and for such purpose, said person or party may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based (Chapter 286, Florida Statutes).   In compliance with the Americans with Disabilities Act (ADA), anyone who needs a special accommodation for this meeting should contact the City Clerk at (321) 837-7774 at least 48 hours in advance of this meeting. The public hearing may be continued to a time and date certain by announcement at this scheduled hearing without any further published notice.
